General Terms and Conditions of Sale Allomouton


The present conditions of sale are concluded between, on the one hand by SAS SAUFRA TRADING, with a capital of 20,000, whose registered office is located at 45-63 avenue du général Leclerc, 93120 LA COURNEUVE, registered in the Bobigny Trade and Companies Register under the SIRET number 808 952 069, (hereinafter referred to as "ALLO MOUTON"), on the one hand, and on the other hand, by any individual or legal entity wishing to make a purchase from ALLO MOUTON (hereinafter referred to as "the Customer").

 

ARTICLE 1 - PREAMBLE

The present general terms and conditions of sale are applicable to purchases made by Customers within the framework of the online sales services of halal mutton (hereinafter referred to as the "Product") set up to facilitate the collection and delivery of the merchandise:

- Pick-up at a storage point located at Parc des 6 routes, 45-63 avenue du général Leclerc, 93290 LA COURNEUVE, with no minimum purchase, on orders placed from the ALLO MOUTON website accessible from the address www.allomouton.com

- The provision of the Product to a charity if the Customer has wished to make a donation of his order and therefore does not imply the withdrawal by the Customer of the Product at a storage point;

Any order taken implies the consultation and prior full acceptance by the Customer of the present general sales conditions.

On the ALLO MOUTON Internet site, this acceptance is materialized when the Customer validates his/her "shopping cart" by clicking on the "I accept the general sales conditions" button. 

The Customer declares that the acquisition of the Products is not directly related to any professional activity, their acquisition being exclusively intended for private and non-professional personal use, any resale being forbidden. The Customer must inform ALLO MOUTON of any reverse use.

Consequently, ALLO MOUTON reserves the right not to accept an order, particularly if it is abnormal with regard to the practices generally observed during religious practices.

 

ARTICLE 2 - PURPOSE

The purpose of the present general terms and conditions of sale is to govern the relationship between the Customer placing an order and ALLO MOUTON.

They complete the specific conditions of sale (in particular product names, prices, weights, slaughter methods, etc.) appearing on the ALLO MOUTON website.

 

ARTICLE 3 - PRODUCTS OFFERED

Only the products offered on the ALLO MOUTON website can be ordered.

Despite all the precautions taken by ALLO MOUTON, the availability of products cannot be totally guaranteed, as quantities are limited.

For this reason, an availability indicator is set up on the ALLO MOUTON website.

ALLO MOUTON makes every effort to ensure that the Customer cannot place an order if the stock is exhausted.

However, if an order were to be placed when no Products were available, ALLO MOUTON would refund the said order if it had been paid for and could not be held responsible for any prejudice.

The customer is fully informed that the weight indicated in the order is the average weight after slaughter (carcass). Once packaged, the average weight of the vacuum-packed meat is necessarily less than that of the carcass (at least 15%) because of the loss of certain elements during the cutting process (bones, fat, etc.).

In fact, once slaughtered and prepared, the average weight of the meat is necessarily lower than that of the animal (at least 15% lower).

The characteristics of the Products can be modified and adapted at any time.

Each Product is accompanied by a description drawn up by ALLO MOUTON on the basis of information provided by its suppliers. The photographs of the Products are as accurate as possible, but cannot ensure a perfect similarity with the product offered, particularly with regard to colors. Moreover, all illustrations available on the site do not have a contractual value.

Therefore, only the information on the product packaging is binding on ALLO MOUTON.

It is therefore the responsibility of the Customer, in particular if he/she is subject to allergies, to refer to the list of ingredients on the packaging at the time of collection or by contacting the consumer service before any consumption.

ARTICLE 4 - STORAGE POINT OF THE ORDERED PRODUCTS

The Products ordered are available at the storage point chosen by the Customer at the time of ordering.

Once available at the storage point, the Customer has :

- For Aid-el Adha: 5 days from receipt of the goods at the collection point.

- For births: 5 days from the receipt of the goods at the place of collection.

- For purchases: 5 days from receipt of the goods at the place of collection.

After this period, the Customer must inform ALLO MOUTON of the date of collection and is hereby fully informed (i) that a daily penalty of 5 euros corresponding to the storage costs will be applied, payable before the collection of the Product(s), as well as the perishable nature of the Product(s). In this respect, as the Product's use-by date approaches, ALLO MOUTON will no longer be able to guarantee its conservation in optimal conditions and in compliance with current legislation and, as such, reserves the right to destroy or have destroyed the Product. No compensation and/or reimbursement can be claimed by the Customer. 


For the Aid-el-Adha, after a period of 10 days, the lambs of particular purchase are automatically frozen so that the customer can recover it in the most optimal conditions and without deteriorating the product. Without prior request from the customer, in order to avoid any food waste, we reserve the right to give your lamb to our partner associations.

 

ARTICLE 5 - ORDER TAKING

The order is made online, on the website www.allomouton.com.

For this purpose, the Customer must enter his e-mail address and password if he already has a Customer account on the website.

As part of the storage point collection service, as soon as the Customer has validated his "basket", the website displays the date from which his order will be available as well as the opening hours and the full address of the storage point.

 The Customer selects the desired Products. These are added to the list of selected products and can be consulted in the banner at the top right of the screen.

Once the selection is made, the Customer can modify or validate his "basket" by clicking on the button "modify or validate my basket" in the "basket" that can be consulted in the banner located at the top right of the screen. It is therefore up to the Customer to check the Products included in his order.

If the Customer already has an ALLO MOUTON account on the www.allomouton.com website, he/she simply needs to enter his/her e-mail address and password to retrieve his/her information. Otherwise, he/she must create his/her account from the "my account" page of the site by entering his/her e-mail address and a password that he/she will have chosen (the password must be composed of at least 5 characters), his/her surname, first name and date of birth.

Failure to provide this information is equivalent to giving up the creation of an account.

If the Customer forgets his or her password, he or she can automatically receive a new password by e-mail by clicking on the link "Forgot your password?  The Customer agrees to provide true and sincere information, and ALLO MOUTON cannot be held responsible for any erroneous information. 

 

ARTICLE 6 - PAYMENT

The amount of the order is indicated when the order is placed.

It is indicated including all taxes.

The payment is made either : 

- By credit card, on the Internet via our payment solution

- By Paypal. ALLO MOUTON will acknowledge receipt of the payment and only the sending of the confirmation message from Paypal to ALLO MOUTON will constitute proof of payment, in addition to the proof of credit on ALLO MOUTON's bank account.

- No payment by check or cash can be made on the website.

 

ARTICLE 7 - SUMMARY OF THE ORDER 

The website displays a summary of the Customer's order, which is simultaneously sent to the Customer by e-mail to the e-mail address that the Customer has provided. 

 

ARTICLE 8 - ORDER CONFIRMATION

Within a maximum of 48 hours after the order (Monday to Friday, excluding holidays and days of closure), the Customer will receive an e-mail confirming the terms of his order and the date (with an indicative schedule) of estimated availability.

Only the date indicated in this e-mail will be considered as authentic. 


ARTICLE 9 - CONDITIONS OF WITHDRAWAL FROM STORAGE POINTS

The Customer must respect the conditions of withdrawal from the storage points. The Customer shall ensure that he/she is able to transport the Product at his/her own expense to its destination.

ALLO MOUTON is no longer responsible for the Product once it has been removed.  

The duration of the provision of the Product(s) as specified in Article 4.  

ALLO MOUTON may, if it deems it useful, ask the Client to show proof of identity before handing over the order, accompanied by the corresponding invoice.

If the Customer mandates a third party to proceed with the collection, this third party must have his own identification and a copy of the Customer's identification.

Despite all the care taken by ALLO MOUTON in the preparation of orders, it is the responsibility of the Customer to verify the conformity of the order with the order (quantity, state of the packaging, missing product, etc.).

Any product that does not comply with the order may be refused and the corresponding price will be deducted from the payment and then refunded. To do so, the Customer shall immediately notify ALLO MOUTON. 

 

ARTICLE 10 - RESPECT OF THE COLD CHAIN

ALLO MOUTON guarantees that the cold chain will be respected until the Products are picked up.

The Customer's attention is drawn to the fact that once the order has been collected, it is the Customer's responsibility to ensure that the products are kept in good condition.

The Customer is also informed on the labeling of the Product of the deadline of consumption.

In this respect, it is specified that, with regard to the type of Product, the use-by date is a maximum of 21 days for meat delivered cut up and vacuum-packed and 5 days for meat delivered as a carcass.

It is therefore up to the Client to take the necessary measures to preserve the Product and freeze it if necessary. ALLO MOUTON shall not be held responsible for any failure to observe the usual precautions concerning food safety.

 

ARTICLE 11 - FORCE MAJEURE

Force majeure or any other situation beyond the control of ALLO MOUTON that causes a delay or prevents the Products from being made available to the Client shall not entitle the Client to any compensation. 

 

ARTICLE 12 - NO RETURN OF PRODUCTS

The Customer is fully aware that once the Products have been removed, they cannot be returned due to their perishable nature. 

 

ARTICLE 13 - PROTECTION OF PERSONAL DATA

In the event of any violation or infringement of the present conditions of sale, ALLO MOUTON reserves the right to suspend or terminate the validity of the User ID.

 

ARTICLE 14 - INTELLECTUAL PROPERTY

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a personal nature relating to buyers may be subject to automated processing.

Likewise, the Customer has the right to access and rectify data concerning them in accordance with the law of 6 January 1978. 

ALLO MOUTON reserves the right to collect information on the Customer, including by using cookies, and if the Customer so wishes, to transmit the information collected to partners.

All elements of the www.allomouton.com website are and remain the exclusive intellectual property of ALLO MOUTON. All rights of use are reserved. The "ALLO MOUTON" brand and its logo are registered trademarks; any reproduction, in whole or in part, by any means whatsoever, constitutes an infringement of the literary and artistic property code.

No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, the elements of the site, software, site layout, visual or audio, without the prior written consent of ALLO MOUTON. Any simple or hypertext link is strictly forbidden without the written consent of ALLO MOUTON.

 

ARTICLE 15 - ARCHIVING - PROOF

In accordance with the law relating to information technology, files and freedom of January 6, 1978, information of a personal nature relating to buyers may be subject to automated processing.

ALLO MOUTON reserves the right to collect information on the buyer, including by using cookies, and if the buyer so wishes, to transmit the information collected to partners.

Buyers may object to the disclosure of their personal information by notifying ALLO MOUTON. Similarly, users have the right to access and rectify data concerning them in accordance with the law of 6 January 1978. The automated processing of information, including the management of users' email addresses has been declared to the CNIL on 09 March 2013 registered under number 1658223.


ARTICLE 16 - MODIFICATIONS TO THE GENERAL SALES CONDITIONS

ALLO MOUTON reserves the right to adapt or modify the present general sales conditions at any time. The version applicable to all transactions is the one that appears online at www.allomouton.com at the time of the order or the one that appears on the paper sales conditions updated and transmitted to the buyer.
